Terms and Conditions

  1. Security Deposit are due within 12 days from making your reservation. Balance is due no later than 60 days prior to your arrival. All payments not received by Maxfield Real Estate 60 days prior to occupancy may result in loss of deposit and cancellation of reservation. No notices will be sent by mail. This contract is not valid until signed by both Tenant and Owner.
  2. Security/damage deposit will be returned within 14 days after tenants have vacated. If there are damages to the premises, excluding reasonable wear and tear, but including extra cleaning charges, extra trash removal charges, pet waste pick-up and lost key charges, the owner/owners agent may direct that the costs of repair be deducted from the security deposit. In such case the Tenant shall be provided with a written, itemized list of damages which will indicate with particularity the nature of the damages to be corrected and that the repair is necessary and has been or will be completed. Where possible, damage reports, labor estimates, bills or invoices will be provided.
  3. CHECK-IN/CHECK-OUT: Check-in time of 3 p.m. is strictly adhered to. There shall be no early check-in under any circumstances. Maxfield Real Estate staff is available to answers questions and assist you with needs until 5 p.m. on the day of check-in and again on the following Monday morning at 10 a.m. Should there be any issues/concerns with a property after 5 p.m. on the day of check-in, Tenant will have access to Maxfield Real Estate staff as of 9 a.m. the following day. Therefore, a timely check-in is encouraged. Check-out time of 10 a.m. must be met to allow cleaning crews enough time to complete their work for the next guest(s). Tenants occupying the property beyond the check-out time, time being of the essence, will be charged an amount equivalent to one days rent for each hour of occupancy beyond the check-out time. This provision shall not be construed to permit the Tenant to stay an additional night or stay beyond the check-out time without having reached prior written agreement with Owner.
  4. CANCELLATION:
    o Rentals may be canceled within 7 days (grace period) of the execution of this rental agreement by Tenant without penalty and any deposits paid being refunded.
    o A fee of twenty percent (20%) of the TOTAL RENT will be charged in the event of a canceled confirmed reservation, following the 7-day grace period, regardless of the reason. The monies paid, less the cancellation fee, will be refunded only if the property is re-rented for the same rate and time.
    o It is recommended that tenants obtain travel insurance in the event of an unforeseen cancellation.
  5. Tenants agree not to use the premises for any purposes which might be designated as hazardous or use the premises, nor suffer them to be used, for any purpose calculated to injure the reputation of the owner, or to impair the value of the surrounding neighborhood property.
  6. OCCUPANCY LIMITS: Strict adherence to occupancy limit is to be observed per your agreement. Maximum occupancy herein is defined as the maximum number of persons (includes all ages) to be at or on the property at any given time.
  7. Premises shall be used for recreational purposes only in a non-offensive manner. No use shall be made thereof which be unlawful, improper, noisy, offensive, or contrary to the State of New Hampshire laws and ordinances, or of local town ordinances. No large gatherings for games of chance, clubs, or other organizations for activities open to the public, will be allowed on the premises. Upon expiration of the rental period, tenants agree to give peaceable possession of the said premises to the owner or his agent in as good a condition as they now are, usual wear excepted.
  8. Cell phones will be needed by the Tenant. Limited local calls are available from the properties where telephone service is available.
  9. In the event of a breach of this agreement, upon demand, tenants agree to yield up the immediate possession to the owner or his agent, and failing to do so, pay liquidated damages for the whole time such possession is withheld at twice the daily rate, but the provisions of this clause shall not be held to be a waiver of the owner or his agent to re-enter immediately at the end of the term or to enter immediately upon violation of any of the provisions herein. In addition, any violation of the terms or conditions of this lease shall result in full forfeiture of the security deposit.
  10. The tenants, upon termination of the term, shall deliver all keys, etc., to the owner or his agent. Tenants agree that on failure to pay the full amount of rent or the breach of any of the terms herein, that the owner or his agent may, without notice, re-enter and take possession thereof of the premises and with or without legal process, evict and dispossess the tenants and any and all persons from the said premises. The re-entry shall not affect the right of the owner or his agent to collect any sums due as rent or damages. Any breach of the provisions of this agreement shall result in the full loss of the security deposit. This shall not be construed to limit damages to the amount of the deposit in the event that damages exceed the amount of the security deposit.
  11. Tenants agree to pay for damages they or any persons entering the building during their occupancy may cause to the interior or the exterior of the building or any portion of the grounds.
  12. Tenants must furnish their own linens, towels, food, cleaning supplies, paper towels, garbage bags and personal items for the rental period. Agents and owners assume no responsibility for any articles left on the premises by tenant.
  13. In the event additional cleaning is necessary which is beyond what would normally be required, tenant will be charged a cleaning fee based on an hourly rate of $30 per hour (subject to change). This fee is in addition to the cleaning fee that is noted above. Tenant may be charged for excessive trash left behind at the property.
  14. LIMITATIONS: a) No campfires may be kindled upon the property. b) No tents, trailers, nor mobile homes may be used upon the site. c) No Fireworks of any kind are permitted on the property.
  15. Returned checks subject to $50.00 check handling charge.
  16. WEATHER/LAKE LEVEL: Lake levels may vary by several feet throughout the season based on weather conditions and other controls of lake levels. This may affect beach size, rough water/waves, launching areas and water depths at the property. NO REFUNDS will be made for unforeseen events/damage occurring due to inclement weather or storms.
  17. ERRORS & OMISSIONS: Rental Agents have made every effort to provide accurate information about the property. Rental Agents shall not be responsible for errors, omissions, or any changes with regards to the property. All rental properties are privately owned and are outfitted individually according to the owner’s taste and may change from time to time.
  18. Owners and/or Agents are not responsible for any injury sustained while on property.
  19. The parties agree that all notices shall be deemed given if sent to Tenant at address set forth below. All notices shall be deemed given to Maxfield Real Estate if received by mail at 15 Railroad Avenue, P.O. Box 738, Wolfeboro, NH 03894
  20. The tenant(s) enter this agreement having had the opportunity to inspect the property. Tenant(s) shall not rely upon any statements or representations made by Maxfield Real Estate or its agents with respect to the property’s level of suitability for a specific use or with respect to property condition. Maxfield Real Estate strongly recommends that Tenant complete a property inspection within the 7-day grace period to assure that all aspects of the property meet with Tenants expectations. Lake levels are state controlled and fluctuate according to rainfall. Beach areas vary in size according to lake levels.
  21. PARKING: Many properties have limited parking available to guests. No more than 4 cars should be parked on the premises at any time.
  22. SUBLETTING: Tenant acknowledges that the Property may NOT be sublet. Subletting shall lead to immediate eviction and forfeiture of all rents and deposits.
  23. Smoking is not allowed.
